Eggs Benedict Tech LLC, a Michigan limited liability company ("EBT," "we," "us," or "our"), provides this Privacy Policy to explain how we collect, use, and disclose information in connection with our website at https://eggsbenedict.tech, our business operations, marketplace transactions, and the artificial-intelligence assistant products and services we design, configure, and deploy (collectively, the "Services"). United States only. Our Services are offered solely to businesses and organizations located in the United States. We do not offer the Services to consumers or to individuals or entities located outside the United States, and this Policy is written for United States privacy laws only. The European Union General Data Protection Regulation, the United Kingdom GDPR, and similar non-United States laws do not apply to our Services, and we do not rely on standard contractual clauses or maintain an EU or UK representative. Business context. We deal with businesses and their personnel. The personal information we handle is generally business-contact and business-account information, not consumer information collected in a personal or household context.
To avoid any confusion, this Policy distinguishes between two separate scopes: 1.1 Our own business information. Like any business, we collect certain information when you visit our website, contact us, request a quote, transact through a marketplace, or become a customer, such as your business-contact details, inquiry and order information, marketplace messages, and billing or transaction status. This is described in Sections 2 through 6. 1.2 Data handled inside the AI assistants we build. Separately, when we build and deploy an AI assistant for a customer, that application may contain one or more conversational personas that handle the customer's own content and its end users' interactions. How that data is handled depends on the Data-Handling Standard the customer selects, and for our Tier 0 (Zero-Retention) standard the delivered application is designed to log and persist no conversation content. The commercial Package Tier does not change these retention or privacy commitments. This is described in Section 10. Important. Our "Zero-Retention" and "EBT Zero-Retention Verified" standard describes the architecture of the AI assistant application we deliver. It does not mean that EBT collects no information at the company level. As Sections 2 through 6 explain, we collect ordinary business, website, marketplace, and transaction information to run our business.
2.1 Information you provide. We collect information you give us, including: ● Contact and organization details: your name, role, business email, organization name, website, and how you heard about us. ● Inquiry and project details: information you submit through our intake and scoping form or otherwise share when you ask us to scope an engagement. We ask that you describe, rather than upload, confidential, personal, or regulated material at the inquiry stage; a mutual non- disclosure agreement is available before any such material changes hands. ● Account details: credentials and settings if you create an EBT account. ● Marketplace order information: information Fiverr, Fiverr Pro, Upwork, or another marketplace makes available to us, such as your profile or display name, business identity and role, disclosed end client, order or contract ID, selected package, requirements, messages, attachments, delivery, revision, acceptance, cancellation or dispute activity, transaction status, and related platform metadata. ● Billing and transaction details: billing contact and payment status. Direct payments are processed by PayPal. Marketplace payments are processed by the applicable marketplace and its payment or escrow providers. EBT does not store or receive full payment-card numbers. ● Communications: the content of emails, contact-form submissions, and marketplace messages, including files you choose to send. 2.2 Google Analytics 4 and consent. We use Google Analytics 4 (GA4), provided by Google LLC, only after you affirmatively opt in through our cookie banner. Until you select 'Accept analytics,' the GA4 tag is not loaded and no GA4 request is sent. If you opt in, GA4 may use cookies and similar technologies to collect device and usage information, such as IP address, browser and device type, pages viewed, referring pages, approximate location derived from IP address, and interaction events. We store your consent choice on your device so the site can honor it. You can withdraw or change that choice through the site's cookie controls and can also use browser controls or Google's available opt-out tools. We do not use Google Signals, ads personalization, remarketing, User-ID, or other GA4 advertising features. Google's handling of GA4 data is governed by the Google Privacy Policy and is further described in Google's explanation of how it uses information from sites or apps that use its services. The AI assistants we deliver are designed to emit only content-free operational data (such as counts, timing, and error signals) to us, if any, and, for Tier 0 builds, to log and persist no conversation content server-side. See Section 10. 2.4 No sensitive or regulated data by default. We do not seek, and ask that you not provide, protected health information, cardholder data, government-identifier numbers, or other specially regulated data, except under a separate written agreement.
We use the information described above to: ● respond to inquiries, scope engagements, and provide quotes; ● form, administer, deliver, revise, accept, cancel, and resolve disputes relating to marketplace and direct orders; ● provide, configure, deploy, verify, and support the Services; ● manage accounts, process payments through the applicable provider, and maintain business and transaction records; ● operate, secure, analyze, and improve our website and Services, using content-free, aggregated, or de-identified data where feasible; ● communicate about the Services through email, our site, or the marketplace workroom, including service, administrative, delivery, revision, and platform-compliance messages; ● comply with law, applicable marketplace terms, and our agreements. We do not use the content of a customer's Reference Material, prompts, or interactions inside a delivered assistant to train, fine-tune, or improve our own or any third party's general-purpose machine-learning models. See Section 10.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose information only as follows: ● Service providers / sub-processors: to vendors that perform services for us under terms that limit their use of the information to providing services to us. Our primary providers include Google Cloud Platform for AI and hosting infrastructure, PayPal for direct billing, and Google LLC for GA4 when you opt in. A current list is available on request. See Section 10 for the AI infrastructure provider's role. ● Independent marketplace providers: when you choose Fiverr or Upwork, the marketplace and its payment, escrow, messaging, fraud-prevention, and dispute providers collect and process information under their own terms and privacy notices. These include Fiverr International Ltd. and its relevant payment providers, and Upwork Global LLC, Payment Escrow Inc., and their relevant affiliates and providers. EBT receives the order, identity, message, file, transaction-status, and dispute information they make available to us and may disclose order, delivery, acceptance, cancellation, refund, chargeback, and dispute information back through the platform as needed to administer and enforce the order. Their privacy notices govern their independent processing. See Fiverr Privacy Policy and Upwork Privacy Policy. ● Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy. ● Legal and safety: to comply with law or legal process, enforce our agreements or applicable marketplace rules, or protect the rights, safety, or property of EBT, our customers, or others. ● With your direction or consent: as you otherwise direct or authorize.
We do not sell personal information for monetary or other valuable consideration, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act, as amended (the "CCPA"). We have not done so in the preceding twelve months. If this ever changes, we will update this Policy and provide any required opt-out mechanism.
We retain business information only for as long as reasonably necessary for the purposes described in this Policy, to maintain required business and financial records, to administer marketplace orders, to comply with applicable platform recordkeeping or dispute requirements, to resolve disputes, and to comply with law, after which we delete or de-identify it. Intake and inquiry information for prospects we do not engage is deleted on verified request unless a legal, platform, or recordkeeping obligation requires retention. Marketplace providers retain information under their own privacy notices and terms. Data handling inside delivered assistants is governed by the applicable Data-Handling Standard and the Data Processing Addendum; for Tier 0 builds, the delivered application retains no conversation content.
We maintain administrative, technical, and physical safeguards designed to protect information in our possession, appropriate to its nature. Our AI builds use enterprise Google Cloud infrastructure with server-side model access, secrets management, and keyless deployment. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Marketplace security is governed by the applicable provider's own practices and terms.
Depending on your state of residence and the applicable law, you may have some or all of the following rights regarding personal information we hold about you: the right to know or access the personal information we have collected; the right to correct inaccurate personal information; the right to delete personal information; the right to obtain a copy or portability of personal information; and the right to opt out of the sale or sharing of personal information or certain profiling. We do not sell or share personal information, as described in Section 5. 8.1 California (CCPA/CPRA). California residents, including individuals acting as business contacts, have the rights described above. We do not use or disclose sensitive personal information for purposes that would trigger a right to limit its use. We will not discriminate against you for exercising your rights. 8.2 Other states. Residents of states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Utah, Texas, and other states as those laws take effect, may have similar rights, subject to the exemptions and thresholds in each law. Because we serve businesses, some of these laws or their exemptions may or may not apply to a given interaction; we nonetheless offer the request mechanism below to all United States residents. 8.3 How to exercise your rights. Submit a request by contacting us at orlando@eggsbenedict.tech. We will verify your request as required by law, respond within the timeframes the applicable law requires, and, where the law allows, you may use an authorized agent. You may appeal a denial by contacting us at the same address, and we will inform you of the outcome as required by applicable law. Requests directed to Fiverr, Upwork, Google, or PayPal about information they independently control must be submitted to the applicable provider under its privacy notice.
Our Services are for businesses and are not directed to children. We do not knowingly collect personal information from children under 13 (or, where applicable, under 18). We do not permit customers to direct the AI assistants we deliver at children or to collect children's personal information through them without a separate written agreement that addresses the Children's Online Privacy Protection Act, the Family Educational Rights and Privacy Act, and related requirements. If you believe a child has provided us personal information, contact us at orlando@eggsbenedict.tech and we will delete it.
10.1 Data-Handling Standards. How data is handled inside an AI assistant we deliver depends on the Data-Handling Standard the customer selects. Package Tier and commercial extras affect quantity, placement, delivery, and price only and do not alter the selected Data-Handling Standard: ● Tier 0 (EBT Zero-Retention Verified): the delivered application is stateless and is designed to log and persist no prompt, response, generated audio, or retrieved content server-side. Conversation lives only in the end user's own browser session. ● Tier 1 (Governed Retention): scoped, disclosed, and consented retention under a data- processing agreement, for use cases that require memory or auditability. This is not zero- retention and is labeled as such. ● Tier 2 (Standard): conventional, application-appropriate data handling for lower-sensitivity uses. 10.2 AI infrastructure provider. Our AI assistants run on Google Cloud Platform (the Gemini Enterprise Agent Platform, formerly Vertex AI), using models such as gemini-2.5-flash and, for voice features, gemini-2.5-flash-preview-tts. Under the paid enterprise platform, the provider is contractually restricted from training its models on your data. For Tier 0 builds, we configure the project to drive provider-side retention to zero (including requesting a zero-data-retention exception for abuse monitoring where available, avoiding retention-forcing features, and pinning data residency to the region the customer requires), and we verify this per project against a documented checklist. 10.3 What "EBT Zero-Retention Verified" means and does not mean. "EBT Zero-Retention Verified" is our own published standard, verified per build by our automated test suite (for the application we deliver) and per project by our provider-configuration checklist (for the infrastructure). It is a described methodology, not an express warranty or guarantee of a result, and it is not a third- party certification. It describes the delivered application's architecture; it does not mean EBT collects no business information at the company level (see Sections 2 through 6), and it does not mean the underlying infrastructure provider retains nothing. Certain transient, provider-classified zero-retention mechanisms (for example, RAM-only, project-isolated, short-lived in-memory caching) may operate at the infrastructure layer. After hand-off, the customer owns and operates the deployed assistant and is responsible for its ongoing configuration and privacy practices. 10.4 Training restriction. We do not use your Reference Material, prompts, or interaction content to train, fine-tune, or improve our own or any third party's general-purpose models, consistent with our Floor commitments.
We may update this Policy from time to time. We will post the updated Policy with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
